Regulations of Rynek 24 Apartments

§ 1. Introduction

These regulations define the terms of reservation and rental of the Rynek 24 Apartments in Rzeszów.

Making a reservation constitutes the conclusion of an apartment rental agreement between Marcin Czarnik Doradztwo Inżynierskie – sole proprietorship (hereinafter also referred to as the Lessor) and the Guest, under the conditions specified in these regulations.

These regulations were created to ensure a peaceful and safe stay, and we kindly ask you to follow them.

§ 2. Reservations and Payments

To make a reservation, please use the booking system available at www.apartamenty-rynek24.pl, online booking platforms, by email at biuro@apartamenty-rynek24.pl, or by phone between 9:00 and 17:00 at +48 606 199 540.

When making a reservation by phone or email, please provide the stay dates, selected apartment, contact details, number of guests, and arrival time.

A reservation requires payment of the full rental price to the provided bank account within 24 hours of receiving preliminary reservation confirmation from the Lessor.

The condition for issuing keys (PIN code) is the payment being recorded in the Lessor’s bank account. Cash payments on-site are not accepted.

If the full rental amount is not paid within the specified time, the Lessor has the right to freely reassign the apartment, including renting it to another guest.

Due to possible delays in payment processing, please send proof of payment by email to: biuro@apartamenty-rynek24.pl.

The Guest has the right to shorten the stay and adjust the rental price if the change is made no later than 14 days before the planned arrival. After this period, shortening the stay will not affect the agreed rental price. This does not apply to Guests booking under promotional pricing.

If the reservation is cancelled up to 14 days before arrival, the Guest will receive a full refund. After this period, the payment is non-refundable.

The Lessor is not obliged to refund money for unused days of stay.

Payments can be made via electronic transfer or payment card. Card and online transfer transactions are processed via: Przelewy24 – PayPro S.A. ul. Kanclerska 15, 60-327 Poznań.

In the transfer title, please include the reservation number, guest’s name, and arrival date.

Upon request, the Lessor will issue a VAT invoice. Please inform the Lessor during the reservation process and provide the necessary invoicing details.

§ 3. Arrival and Key Collection

The hotel day lasts from 15:00 on the day of arrival until 11:00 on the day of departure.

Guests may check in between 15:00 and 22:00. Later check-in is possible upon prior arrangement with the Owner.

After completing the reservation and paying the full amount, the Guest will receive a PIN CODE sent to the phone number provided during booking. The PIN code opens the electronic lock to the apartment. It consists of eight randomly generated digits and is valid only for the duration of the Guest’s stay.

§ 4. Apartment Rental Service

The Lessor provides the Guest with the entire Apartment, including furniture and equipment.

The apartment equipment includes RTV and household appliances, as well as bedding and a set of towels for each Guest.

The rental price includes all taxes, utilities (electricity, water, heating, TV, Internet), and cleaning before the Guest’s arrival.

For stays up to 7 days, additional cleaning and linen/towel replacement are available for an extra fee of 50 PLN per person.

For stays longer than 7 days, the apartment is cleaned once a week, including linen and towel replacement.

A parking space near the Market Square may be available for the apartment, but the number of spaces is limited.

§ 5. Guest Responsibilities

The Guest agrees to use the apartment exclusively for residential purposes and may not sublet it or make it available free of charge to third parties.

The apartment may not be occupied by more people than the number declared during the reservation process. If it is found that more people are staying in the apartment, the Lessor has the right to terminate the agreement with immediate effect without refund for the remaining rental period or to charge an additional fee for extra persons staying in the apartment.

The Guest is obliged to respect the principles of good neighbourly conduct. If the Guest significantly disturbs the peace or violates the rights of neighbours, or fails to comply with commonly accepted social norms, the Lessor reserves the right to terminate the agreement with immediate effect without refund for the unused rental period.

The Guest must maintain the apartment in the condition in which it was found at the beginning of the stay. Rearranging furniture or moving RTV/household appliances without the Lessor’s consent is prohibited.

Quiet hours apply from 22:00 to 6:00.

The Guest bears full financial responsibility for any damage or destruction of the apartment, its furnishings, equipment, or missing items caused by the Guest or persons visiting them.

In the event of damage, the Guest must immediately notify the Lessor.

Any damage or defects found upon entering the apartment must be reported to the Lessor immediately. Failure to report may result in the Guest being charged for repairs.

The Lessor reserves the right to collect a refundable deposit of 500 PLN to cover potential damages by pre-authorizing the Guest’s credit card and charging the card in case of damage.

For safety and comfort reasons, and due to the fire protection system installed in the building, smoking and the use of candles are strictly prohibited throughout the building. In case of violation of the smoking ban, the Lessor will charge the Guest a contractual penalty of 500 PLN. Persistent violation of the smoking ban may result in immediate termination of the agreement without refund.

The use of electrical devices other than those provided in the apartment is prohibited, except for computers, laptops, shavers, hair dryers, and phone chargers.

Pets are not allowed in the apartment.

The Lessor may refuse accommodation to a Guest who, during a previous stay, seriously violated the regulations, caused damage, or breached good neighbourly conduct.

The Lessor reserves the right to refuse accommodation to Guests under the influence of alcohol or intoxicants, or behaving aggressively, thereby posing a threat to others or to property.

The apartment is intended for residential purposes only. Organizing parties, events, photo sessions, bachelor or bachelorette parties is prohibited.

The Lessor may enter the rented apartment only in cases of safety concerns, violation of the regulations, media failures, or if the Guest fails to vacate the apartment by 11:00 on the day of departure.

If the Guest does not vacate the apartment by 11:00, the Lessor is entitled to enter the apartment in the Guest’s absence and move their belongings to the reception area or charge the Guest for an additional night.

§ 6. Lessor’s Responsibilities and Liability

The Lessor undertakes to remove any defects in the apartment without undue delay, within a maximum of 24 hours from the moment the defect is reported, unless the nature of the defect requires a longer repair time. Failures caused by reasons beyond the Lessor’s control, such as interruptions in utility or Internet supply, do not constitute grounds for cancellation or price reduction.

If unforeseen circumstances occur that cannot be immediately resolved, the Lessor reserves the right to offer the Guest an alternative apartment, if available.

In the event of force majeure, the Lessor may withdraw from the agreement. This also applies when the personal safety of the Guest or their property cannot be guaranteed for reasons beyond the Lessor’s control. In such cases, payments made by the Guest will be refunded immediately, minus charges for services already provided.

The Lessor is not responsible for personal belongings left in the apartment or stolen from the apartment in the event of a break-in.

The Lessor is not responsible for inconveniences caused by noise from other apartments, the restaurant located on the ground floor, or noise from the Old Town Market Square. Please note that events frequently take place on the Rzeszów Market Square, especially in summer, generating significant noise. Numerous pubs and restaurants, including outdoor beer gardens in summer, also contribute to increased noise levels.

The Lessor is not responsible for interruptions in the supply of utilities (electricity, water, Internet, TV) due to reasons beyond their control.

The Lessor is not liable for legal or civil claims in the event of accidents, bodily injury, or death of Guests or third parties on the premises of the apartment during the Guest’s stay.

§ 7. Child Stay

A child up to five years old may stay in the apartment free of charge if the child sleeps with an adult guardian or in their own crib that does not require an additional set of bedding or towels. One child per guardian may stay free of charge. If the number of children eligible for free stay exceeds the number of guardians, the additional children will be charged as regular guests.

A baby crib can be provided in the apartment upon request. The fee for this service is 50 PLN per night.

§ 8. Complaints

Guests have the right to submit complaints regarding any deficiencies in the quality of services provided.

All complaints should be submitted to the Lessor at the postal address provided in the contact details or via email at biuro@apartamenty-rynek24.pl.

Complaints will be reviewed within 10 business days, and the Guest will be informed of the outcome by mail or email.

§ 9. Final Provisions

In matters not covered by these regulations, the provisions of Polish law shall apply.

Any disputes shall be resolved by the court having jurisdiction over the Lessor’s registered office.

PROCESSING OF PERSONAL DATA

Processing of Personal Data

Personal data will be processed for the purpose of carrying out the reservation process, clarifying circumstances of any potential violations of the Regulations or applicable law, and handling any complaints.

In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), we inform you that:

The Controller of personal data obtained during the reservation process, within the meaning of applicable law, is:

The entity processing personal data is the online reservation system Hotres.pl, owned by HOTRES Sp. z o.o. located in Jelenia Góra, 58‑000, ul. Osiedle Robotnicze 10/4, hereinafter referred to as Hotres.pl.

Personal Data

For the purpose of the reservation process and issuing sales documents, the Guest’s personal data is collected. Providing personal data is voluntary but necessary to complete the reservation.

The Guest has the right to access their personal data, rectify it, delete it, and restrict its processing.

Optional consent for processing data for marketing purposes requires checking the appropriate checkbox during the reservation process.

This consent may be withdrawn by sending a message to: biuro@apartamenty-rynek24.pl.

Detailed purposes and scope of data processing in the Hotres system are specified in the attached document.

 

Controller’s Obligations

The Controller ensures that the Guest’s personal data is not shared with third parties and will take all necessary measures, using their knowledge and experience, to uphold this commitment.

The Controller reserves the right to share personal data with authorized entities (Sub‑processors) and in cases required by applicable law. This includes, in particular, entities such as online payment systems and reception software.

The Controller is obliged to maintain confidentiality of all information obtained for the purpose of the reservation process. This obligation remains in force indefinitely.

Hotres.pl Obligations

Hotres.pl, as the entity processing the Guest’s personal data, ensures the implementation of appropriate technical and organizational measures, as well as additional IT security safeguards, based on reliable servers and systems used for processing personal data in electronic services.

Hotres.pl declares that the IT systems used for processing personal data comply with applicable legal requirements and are protected at a high level within the meaning of the Regulation of the Minister of Internal Affairs and Administration of 29 April 2004 on documentation of personal data processing and technical and organizational conditions for devices and IT systems used for personal data processing.

Subcontractors and employees of Hotres.pl will be duly authorized to process personal data in connection with the reservation process, to which both the Controller and the Guest give their consent.

To ensure the highest level of security in storing personal data in compliance with GDPR requirements, Hotres.pl undertakes to:

•               encrypt and anonymize personal data transmissions

•               continuously ensure the confidentiality, integrity, availability, and resilience of processing systems and services

•               maintain the ability to quickly restore access to personal data in the event of a physical or technical incident

•               regularly test, assess, and evaluate the effectiveness of technical and organizational measures ensuring secure data processing

 

Final Provisions

The Controller is entitled to amend the provisions of the Regulations at any time and at their own discretion. In particular, amendments may be made in the event of:

•               the need to adapt the Regulations to mandatory legal provisions or changes in law affecting its content

•               the need to adapt the Regulations to recommendations, interpretations, rulings, decisions, or orders issued by public authorities or courts

•               expansion or modification of the functionalities of Hotres.pl
